Abstract

تُعتبر السلطة التقديرية للإدارة في مجال القرارات الإدارية من أهم الآليات التي تعتمد عليها الدول لبناء أداء إداري مهني قوي. وهي من العناصر الفاعلة لتحقيق التنمية المستدامة ومواكبة الخدمة العامة للمستجدات والاحتياجات العاجلة والعصرية، في إطار تحقيق تقدم حقيقي وملموس في مجال حفظ وحماية المصلحة العامة والمصلحة العامة. ولهذا، أولى المشرع الجزائري السلطة التقديرية للإدارة في مجال القرارات الإدارية أولوية قصوى، تحقيقًا للأهداف المرجوة من هذا العمل. وفي هذا الصدد، أصدر المشرع الجزائري، كغيره من المشرعين في النظم المقارنة، مجموعة من القوانين لتنظيم هذه الآليات، بهدف منح الإدارة الأساس القانوني الذي تستحقه. والهدف من كل ذلك هو ضمان الاستخدام الأمثل والفعال لهذه النصوص والآليات، وضمان الحفاظ على توجه الدولة وسيادتها في هذا السياق، وتمكين جميع أصحاب المصلحة من حماية حقوقهم من أي انتهاك قد يمسها. The discretionary power of the administration in the area of administrative decisions is considered one of the most important mechanisms upon which countries rely to build strong professional administrative performance. It is one of the effective elements for achieving sustainable development and keeping the public service abreast of new developments and urgent and modern needs, within the framework of achieving real and significant progress in the field of preserving and protecting the public interest and public benefit. To this end, the Algerian legislator has given top priority to the discretionary power of the administration in the area of administrative decisions, in order to achieve the desired objectives of such work. In this regard, the Algerian legislator, like others in comparative systems, has issued a set of laws to regulate these mechanisms. Their objective must be to grant the administration the legal basis it deserves. The goal of all of this is to ensure the optimal and effective use of these texts and mechanisms, to ensure the preservation of the state's direction and sovereignty in this context, and to enable all stakeholders to protect their rights from any violation that may affect them.
