دور المرجعية القرآنية في بناء العدالة التشريعية

Abstract

يُشكل القانون في فلسفته المعاصرة أداةً مركزية لضبط التوازن الاجتماعي، إلا أن هيمنة المادية القانونية أدت إلى اتساع الفجوة بين حرفية النص وروحيّة العدالة. وتكمن أهمية هذه الدراسة في تسليط الضوء على المرجعية القرآنية بوصفها إطاراً فوق دستوري يمتلك الأدوات المنهجية الكفيلة بـ "أنسنة التشريع" وإخراجه من جفاف المرجعيات الوضعية. وتتمحور المشكلة البحثية حول تساؤل مركزي مفاده: إلى أي مدى يمكن للمرجعية القرآنية بمقاصدها الجامعة أن تلعب دوراً منهجياً يحقق عدالة تشريعية متوازنة بين القيم الإلهية والواقع التشريعي بتحدياته؟ وقد سعى البحث إلى تحقيق جملة من الأهداف، أبرزها: تأصيل القواعد المقاصدية الكلية (كالميزان والقسط)، وتحديد آليات تفعيلها لمواجهة قصور المرجعيات الوضعية، مع تقديم نموذج تطبيقي لـ "جبر الضرر المعنوي" يختبر نجاعة المنهج المقاصدي في ضبط المفاهيم السائلة. وباعتماد المنهج التحليلي المقارن، خلصت الدراسة إلى أن المرجعية القرآنية تؤسس لنموذج فريد يُبرزُ اقترانَ الرَّحمةِ بالعدلِ، ويقدم "الترضية الجابرة" كبديل أصيل عن تسليع الآلام الإنسانية، مما يثبت قدرة المقاصد على العمل كصمام أمان يضمن مرونة الإجراء وثبات القيمة. وتنتهي الدراسة بتوصية مركزية تقضي بضرورة تفعيل "الرقابة المقاصدية" في صياغة القوانين المدنية المعاصرة، واستلهام معايير "الزجر بالمآلات" لضمان شمولية العدالة للجانبين المادي والمعنوي للإنسان. Summry: Law, in its essence, serves as a fundamental instrument for achieving justice; however, contemporary positive legal thought has increasingly faced the dilemma of "legal alienation," resulting from the dominance of materialism and the rigidity of legal texts when addressing human emotional and moral values. The significance of this study lies in presenting the Qur'anic authority as a supra-constitutional framework capable of restoring the "humanization of law" and achieving the lost balance between textual strictness and the spirit of equity. The paper's primary focus centers on a pivotal question: to what extent can the Qur'anic authority, through its universal Maqasidi objectives, play a methodological role in achieving a balanced legislative justice between divine values and the challenges of the legislative reality? The research aims to uncover the "supra-constitutional" rules within the Holy Qur'an (such as Al-Mizan and Al-Qist) and determine the mechanisms for activating them to address the shortcomings of positive legal frameworks. This is demonstrated through "redressing moral damage" as an empirical model to test the effectiveness of the Maqasidi methodology in regulating fluid concepts. Employing a comparative analytical methodology, the study concludes that the Qur'anic authority establishes a unique model that harmonizes mercy with justice, offering "reparative satisfaction" as an authentic alternative to the commodification of human suffering. This proves the capacity of the Maqasid to act as a safety valve, ensuring procedural flexibility while maintaining value stability. The study concludes with a central recommendation for activating "Maqasidi oversight" in drafting contemporary civil legislation and drawing inspiration from criteria such as "consequential deterrence" to ensure comprehensive justice for both the material and moral dimensions of the human being.
