التحول الرقمي في الإدارة العامة وتحدياته القانونية

Abstract

تهدف هذه الدراسة إلى تحليل التحول الرقمي في الإدارة العامة كضرورة استراتيجية تمليها التطورات التكنولوجية المتسارعة، مع التركيز على التحديات القانونية والتنظيمية المرتبطة به. اعتمدت الدراسة على تكامل المناهج (الوصفي التحليلي، التاريخي، والمقارن) لتغطية الفترة من 2010 إلى 2024. وتوصلت الدراسة إلى أن التحول الرقمي يمثل منعطفاً يتجاوز الرقمنة التقنية ليشمل إعادة هندسة العمليات وتغيير الثقافة التنظيمية. كما خلصت إلى أن حماية البيانات الشخصية والأمن السيبراني يمثلان أكبر العقبات القانونية، مما يستوجب إيجاد إطار تشريعي مرن يوازن بين الابتكار وحقوق المواطنين، مع تعزيز التعاون الدولي لمواجهة التهديدات السيبراني العابرة للحدود. This study aims to analyze digital transformation in public administration as a strategic necessity driven by rapid technological advancements, focusing on the associated legal and regulatory challenges. Utilizing a multi-dimensional methodology (descriptive-analytical, historical, and comparative), the study covers the period from 2010 to 2024. The findings indicate that digital transformation is a pivotal shift that goes beyond technical digitization to include process re-engineering and organizational culture change. It concludes that personal data protection and cybersecurity represent the primary legal obstacles, requiring a flexible legislative framework that balances innovation with citizens' rights, alongside international cooperation to address cross-border cyber threats.
