الآليات القانونية لترشيد الجماعات المحلية في الجزائر

Abstract

تُعدّ الإدارة المحلية ركيزةً أساسيةً في بناء الدولة الحديثة، فهي أداةٌ فعّالةٌ لتجسيد اللامركزية وتحقيق التنمية المحلية المستدامة. وتُمثّل البلدية والدولة أهمّ مستويات هذه الإدارة، حيثُ تلعب الأولى دورًا مباشرًا في تلبية الاحتياجات اليومية للمواطنين، بينما تلعب الثانية دورًا تنسيقيًا ورقابيًا أوسع نطاقًا ضمن نطاقها الجغرافي. وقد أظهرت الدراسة أن الإدارة المحلية، من خلال هذين الهيكلين، تُمثّل أقربَ حلقة وصلٍ للدولة مع المواطنين، وتلعب دورًا محوريًا في تحسين جودة الخدمات وترسيخ مبادئ الحوكمة الرشيدة. ومع ذلك، يكشف الواقع العملي في الجزائر عن عددٍ من التحديات، منها ضعف استقلالية الجماعات المحلية، ونقص الكفاءات، ومحدودية الشفافية والمساءلة، وضعف مشاركة المواطنين. ورغم الإصلاحات القانونية، لا تزال الفجوة بين النصوص والتطبيق قائمة، مما يستدعي رؤيةً استراتيجيةً شاملةً لتعزيز الحوكمة المحلية وتمكين البلديات والولايات من أداء أدوارها بفعالية في إدارة الشؤون العامة. Local administration is a fundamental pillar in building the modern state, as it is an effective tool for embodying decentralization and achieving sustainable local development. The municipality and the state represent the most important levels of this administration. The former plays a direct role in meeting the daily needs of citizens, while the latter plays a broader coordinating and supervisory role within its geographical scope. The study demonstrated that local administration, through these two structures, represents the state's closest interface to citizens and plays a pivotal role in improving the quality of services and enshrining the principles of good governance. However, the practical reality in Algeria reveals a number of challenges, including the weak autonomy of local communities, a lack of competencies, limited transparency and accountability, and weak citizen participation. Despite legal reforms, the gap between texts and implementation still exists, calling for a comprehensive strategic vision to strengthen local governance and enable municipalities and states to effectively perform their roles in managing public affairs
