Abstract

"الحِسبة ودورها في تنظيم الأسواق بتلمسان في العهد الزياني (633هـ - 962هـ / 1235م – 1555م) تهدف هذه الدراسة إلى تسليط الضوء على دور مؤسسة الحِسبة في تنظيم الحياة الاقتصادية والاجتماعية بمدينة تلمسان خلال حكم الدولة الزيانية. فقد شكلت الأسواق مركزًا حيويًا في تلمسان، وتولّى المحتسب تنظيمها ومراقبة المعاملات فيها، مستندًا إلى مبدأ الأمر بالمعروف والنهي عن المنكر، وملتزمًا بضوابط شرعية وأخلاقية صارمة. تناولت الدراسة مفهوم الحِسبة، نشأتها وتطورها في المغرب الإسلامي، ثم ركّزت على دورها العملي في تنظيم الأسواق بتلمسان، من حيث: • ضبط المكاييل والموازين، • محاربة الغش والاحتكار، • تنظيم أسعار السلع، • الإشراف على تصرفات الباعة والمستهلكين، • الحفاظ على نظافة الطرق والأسواق، ومراقبة الآداب العامة. كما عرضت المؤلفات التي أرّخت للحِسبة بالمغرب الإسلامي، وصوّرت المحتسب كشخصية رئيسية في تحقيق العدالة الاقتصادية والاجتماعية، خاصة في مدينة تجارية مثل تلمسان. "Abstract: Al-Ḥisbah and Its Role in Regulating Markets in Tlemcen During the Zayyanid Era (633 AH – 962 AH / 1235 CE – 1555 CE)

This study aims to shed light on the role of the al-Ḥisbah institution in organizing the economic and social life of the city of Tlemcen under the rule of the Zayyanid dynasty. Markets formed a vital center in Tlemcen, and the muḥtasib (market inspector) was responsible for regulating them and monitoring transactions, guided by the principle of enjoining good and forbidding evil, and committed to strict legal and ethical standards.

The study explores the concept of al-Ḥisbah, its origins, and its development in the Islamic West (Maghreb), then focuses on its practical role in regulating Tlemcen's markets in aspects such as:

Standardizing weights and measures,

Combating fraud and monopoly,

Regulating commodity prices,

Overseeing the behavior of sellers and consumers,

Maintaining cleanliness in roads and markets, and enforcing public morality.

It also reviews literary works that documented al-Ḥisbah in the Islamic Maghreb, portraying the muḥtasib as a key figure in achieving economic and social justice—especially in a commercial hub like Tlemcen. "
