A Proposed Model for Transforming Waqf Assets into Business Incubators for Micro-Enterprises

Abstract

We propose a model to develop and operate underutilized waqf assets as incubators for microbusinesses located throughout Algeria. By bridging traditional waqf structures with modern entrepreneurial structures, our research illustrates that a combination of real estate and cash waqf can provide subsidized space for microbusinesses, mentorship for new entrepreneurs, and Sharia compliant financing for new ventures. In addition, our proposed model achieves the goals of maqasid al-Shariah by preserving, protecting and leveraging wealth while developing new innovative ideas to address youth unemployment. The governance structure proposed includes multiple stakeholders, including religious leaders and academic experts to provide oversight and accountability in addition to preserving the rights of the original endowments. The proposed model is also economically viable and provides a dual return on investment, both preserving the core value of waqf and creating a high level of social utility through employment opportunities. Finally, we recommend regulatory reforms to integrate waqf with Algeria's national sustainable development goals. الملخص (باللغة العربية) المداخلة تقترح نموذجًا لتطوير وتشغيل أصول الأوقاف غير المستغلة كحاضنات للمشاريع الصغيرة في جميع أنحاء الجزائر. ومن خلال الربط بين هياكل الأوقاف التقليدية وهياكل ريادة الأعمال الحديثة، يُبين بحثنا أن الجمع بين الوقف العقاري والنقدي يُمكن أن يوفر مساحات مدعومة للمشاريع الصغيرة، وتوجيهًا لرواد الأعمال الجدد، وتمويلًا متوافقًا مع الشريعة الإسلامية للمشاريع الناشئة. إضافةً إلى ذلك، يُحقق نموذجنا المقترح أهداف مقاصد الشريعة من خلال الحفاظ على الثروة وحمايتها وتنميتها، مع تطوير أفكار مبتكرة جديدة لمعالجة بطالة الشباب. ويشمل هيكل الحوكمة المقترح جهات معنية متعددة، بما في ذلك علماء الدين والخبراء الأكاديميين، لتوفير الرقابة والمساءلة، فضلًا عن الحفاظ على حقوق الأوقاف الأصلية. كما أن النموذج المقترح قابل للتطبيق اقتصاديًا، ويُحقق عائدًا مزدوجًا على الاستثمار، إذ يحافظ على القيمة الأساسية للوقف، ويُحقق مستوى عالٍ من المنفعة الاجتماعية من خلال فرص العمل. وأخيرًا، نوصي بإجراء إصلاحات تنظيمية لدمج الوقف مع أهداف التنمية المستدامة الوطنية في الجزائر..
