جرائم القذف والتشهير عبر مواقع التواصل الاجتماعي في التشريع الجزائري

Abstract

تتناول هذه الدراسة الجوانب القانونية لجرائم القذف والتشهير المرتكبة عبر مواقع التواصل الاجتماعي في ظل التشريع الجزائري. تكمن إشكالية الدراسة في كيفية تحقيق التوازن بين حماية حرية التعبير من جهة، وضمان حق الأفراد في حماية حياتهم الخاصة وكرامتهم من جهة أخرى. ونظراً لخطورة الفضاء الرقمي وسرعة انتشار المعلومات فيه، أدرك المشرع الجزائري ضرورة إدراج أحكام قانونية رادعة تعالج هذه السلوكيات غير القانونية. تهدف هذه الدراسة إلى تحليل كيفية تعامل القضاء الجزائري مع هذه الجرائم، واستعراض التحديات التي تواجه تطبيق النصوص القانونية في بيئة رقمية متغيرة، كما تناقش الدراسة الحاجة إلى تعزيز الوعي القانوني وتطوير آليات رقابة فعالة للحفاظ على السلم المجتمعي. This study examines the legal aspects of defamation and libel crimes committed via social media platforms under Algerian legislation. The study addresses the challenge of balancing the protection of freedom of expression with the right of individuals to maintain their privacy and dignity. Given the high risks of the digital environment and the rapid spread of information, the Algerian legislator has integrated specific legal provisions to tackle these unlawful behaviors. This study aims to analyze how the Algerian judiciary handles such crimes and explores the challenges of implementing legal texts within a dynamic digital landscape. Furthermore, the study emphasizes the necessity of enhancing legal awareness among internet users and developing effective monitoring mechanisms to safeguard social peace.
