الطرق العلمية لأثبات النسب

Abstract

عالج هذا البحث مسألة حديثة ومهمة وهي مسألة إثبات النسب بالطرق العلمية، حيث بين البحث الأهمية البالغة التي يحظي بها النسب في كل من الشريعة والقانون ابتداء من طرق إثباته في الشريعة الإسلامية وهي الفراش والإقرار والبينة والقيافة سواء المختلف فيها بين الفقهاء أو المتفق عليها بينهم. أما القانون الجزائري فقد نص على طرق إثباته في المادتين 40و41 من قانون الأسرة وهي الزواج الصحيح ،الإقرار، البينة، نكاح الشبهة أو الفاسد وحديث بالطرق العلمية . وقد اختلف فقهاء الشريعة في مسالة إثبات النسب بالطرق العلمية بين مؤيد ومعارض، إذ أتفق جل الفقهاء على جواز الأخذ بها في إثبات النسب مع ضرورة إحاطتها بضوابط تكفل مصداقيتها، أما القانون الجزائري فقد أجاز الأخذ بالطرق العلمية وجعلها من سلطة القاضي التقديرية. This research has dealt with an important and modern issue: Proving parentage via modern scientific methods This research has shown the great importance proving kinship for both Islamic Sharia and law starting from Islamic sharia ways: confession, evidence, marriage relation and likening which not all fihq scholars agree. The Algerian law, in the other hand, has detailed the ways of proving descent in article 40 and 41 of family code: correct marriage, evidence, confession, suspicious and incomplete marriage; also via modern scientific methods The scholars of the Sharia differed on the question of proving descent through scientific methods between supporters and opponents , most of them has approved using scientific methods in a controlled manner to ensure its credibility. Algerian law has fully adopted it and embedded it to the estimative authority of the judge
