dc.description.abstractتتناول هذه المطبوعة البيداغوجية دراسة قانونية معمقة حول "الملكية العقارية والقيود الواردة عليها"، وهي موجهة لطلبة الحقوق والعلوم القانونية. تستهل المطبوعة بتمهيد يؤصل للموضوع، ثم تنقسم إلى محورين أساسيين؛ يركز المحور الأول على ضبط المفاهيم الأساسية عبر تعريف الملكية العقارية وتحديد نطاق حق الملكية قانوناً. أما المحور الثاني، فيستعرض بالتفصيل "أنواع القيود الواردة على الملكية العقارية"، حيث تم تصنيفها إلى نوعين: قيود مقررة مراعاة للمصلحة الخاصة (مثل: عدم التعسف في استعمال الحق، مضار الجوار غير المألوفة، حق المرور، قيود التلاصق، والقيود الخاصة بالمياه)، وقيود مقررة مراعاة للمصلحة العامة (مثل: نزع الملكية للمنفعة العامة، الاستيلاء المؤقت، الشفعة، الرسوم العقارية، والقيود الواردة في قوانين البيئة، العمران، والتراث الثقافي). تهدف المطبوعة إلى تزويد الطالب بالخلفية النظرية والتطبيقية لكيفية موازنة المشرع بين حرية الملكية الفردية والمصلحة العامة والخاصة
dc.description.sponsorshipThis pedagogical handout provides an in-depth legal study on "Real Estate Property and its Restrictions," tailored for law students. The handout begins with an introductory overview and is structured into two main chapters. The First Chapter focuses on defining real estate property and delimiting the legal scope of property rights. The Second Chapter comprehensively examines the "Types of Restrictions Imposed on Real Estate Property," classifying them into two categories: restrictions established for private interest (such as the abuse of rights, abnormal neighborhood disturbances, the right of way, adjacency restrictions, and water-related regulations) and restrictions established for public interest (including expropriation for public utility, temporary requisition, the right of pre-emption, property taxes, as well as restrictions under environmental, urban planning, and cultural heritage laws). This handout aims to provide students with the theoretical and practical knowledge of how legislation balances individual property rights with private and public interests.
