دور المجلس الأعلى للقضاء في تجسيد استقلالية القضاء في ظل دستور 2020

Abstract

عزز المؤسس الدستوري استقلالية القضاء من خلال النص على تشكيلة المجلس الأعلى للقضاء في صلب الدستور لأول مرة في تاريخ الجزائر، وغلب تمثيل السلطة القضائية فيه، مع إبعاد وزير العدل، بالإضافة إلى الاحتفاظ بالتشكيلة العادية في حال انعقاد المجلس الأعلى للقضاء كهيئة تأديبية. أما فيما يخص الصلاحيات فقد أعطى المؤسس الدستوري المجلس الأعلى للقضاء صلاحية الإشراف الحصري على المسار المهني للقضاة وانضباطهم، كما للمجلس صلاحية إبداء الرأي الملزم في مجال التعيين في المناصب القضائية النوعية، والرأي الاستشاري في مجال ممارسة رئيس الجمهورية لحق العفو. الكلمات المفتاحية: استقلالية القضاء، المسار المهني للقاضي، السلطة القضائية، دستور 2020، تأديب القاضي، انتخاب القضاة، عزل القاضي.The constitutionnelstrenthened the indépendance of the judiciary, by stipulating the formation of the Superme Council of the judiciary in the core of the constitution for the first time inthe historyof Algeria, and the perdominanle of the representation of the judicial, Authority in It with the removeal of the ministre of justice in addition to preserving the regular composition in the event of a meeting the Supreme Judicaël Council as a disciplinary body.
