العملات الرقمية المشفرة بين أحكامها الفقهية وآثارها الاقتصادية

Abstract

"تعدّ العملات الرّقميّة المشفّرة أحد أهمّ النّوازل الفقهيّة المعاصرة الّتي تحمل في طيّاتها الكثير من الغموض، وللمشاركة في توضيح بعض قضايا هذا الموضوع، جاء هذا البحث تحت عنوان: ""العملات الرّقميّة المشفّرة بين أحكامها الفقهيّة وآثارها الاقتصاديّة"" والّتي دارت محاورها حول الإشكاليّة الرئيسيّة: ما هو الحكم الشّرعي للعملات الرّقميّة المشفّرة وماهي آثارها الاقتصاديّة؟ وأُجِيب على هذه الإشكاليّة في ثلاثة مباحث، حيث تناول المبحث الأوّل: مدخل مفاهيمي للعملات الرّقميّة المشفّرة، وتطرق المبحث الثّاني إلى بيان تكييفها الفقهيّ وحكمها ومقاصدها الشّرعيّة وجاء المبحث الثّالث متناولا آثارها الاقتصاديّة على السّياستين النّقديّة والماليّة، والنّظام المالي. كما توصّلنا في خاتمة البحث إلى أهمّ النّتائج وهي: أنّه لا يجوز التّعامل بالعملات الرّقميّة المشفّرة على صورتها الحاليّة، وأنّ العملات الرّقميّة المشفّرة رغم آثارها السّلبيّة على الاقتصاد إلّا أنّها تسير نحو العالميّة. ""Cryptocurrencies is one of the most important Contemporary doctrinal aspects that carry a lot of ambiguity, and to participate in clarifying some issues about this subject, this research came under the title : « cryptocurrencies between the religious jurisprudence and their economic effects » - which focuses on a main question : what is the jurisprudence of cryptocurrencies and what are their economic effects ? In this research, I answer this question in three chapters ; chapter one tackled with a conceptual introduction to cryptocurrencies ; Chapter two dealt with its religious adaptation, judgment and purposes. Chapter three came to discuss the economic effects on monetary and financial policies, and the financial system. At the end of the research, we arrive at the conclusion that : cryptocurrency treatments are unlawful in their current form, and that despite their negative effects on the economy, they are moving globally.
