الترجيح الفقهي: أسسه ومصطلحاته عند ابن يونس (ت 451ه) في كتابه الجامع

Abstract

إن عناية المالكية بكتاب الجامع لابن يونس، وتسميته بـــــ: مصحف المذهب، يدل على مكانته العلمية ونبوغه في تحرير مسائل المذهب المالكي وتهذيبها، وقد امتاز كتابه الجامع بالتأصيل والتدليل والتعليل والترجيح في فقه المسائل الخلافية، مما جعل علماء المذهب المالكي يعدّونه مرجعا مذهبيا لما أشكل من مسائل المدونة، وقد اعتمده الشيخ خليل –رحمه الله – في مختصره الفقهي عند الترجيح بين الأقوال والروايات. إن منهج الترجيح الذي اعتمده ابن يونس في كتابه الجامع قام على أسس وأصول منهجية رصينة، حفظت مكانة وشهرة المذهب المالكي في عصره وما بعده، هذا وقد استعمل ابن يونس في منهجه الترجيحي مصطلحات محددة ومضبوطة، تميّزت بالتفاوت في المراتب والقوة في ترجيح الأقوال والروايات في مسائل الخلاف الفقهي العالي والنازل. إشكالية البحث: تطرح الدراسة الإشكال الرئيس الآتي: ما هي الأسس المعتمدة في الترجيح الفقهي عن ابن يونس في كتابه الجامع؟ وما هي أهم المصطلحات التي استعملها في عملية الترجيح؟ Abstract: The Malikis' attention to Ibn Yunus's book, al-Jami', and its designation as "the Qur'an of the School," testifies to his scholarly stature and brilliance in clarifying and refining the issues of the Maliki school. His book, al-Jami', is distinguished by its foundational principles, evidence, reasoning, and preference in matters of disputed jurisprudence. This led Maliki scholars to consider it a primary reference for resolving complex issues within the Mudawwana. Shaykh Khalil (may God have mercy on him) relied upon it in his abridged work on jurisprudence when weighing different opinions and narrations. The methodology of preference employed by Ibn Yunus in his book, al-Jami', is based on sound methodological principles that preserved the prestige and renown of the Maliki school in his time and beyond. Furthermore, Ibn Yunus used specific and precise terminology in his method of preference, characterized by varying degrees of strength and influence in weighing opinions and narrations in matters of both major and minor legal disagreement. 1. Research Problem: This study poses the following main question: What are the foundations upon which Ibn Yunus relies in his jurisprudential preference in his book, Al-Jami'? And what are the most important terms he used in the process of preference?
