Abstract

تناقش الدراسة الانتقال النوعي في النظام القانوني الجزائري بعد دستور 2020، حيث تحولت الرقابة الدستورية من هيئة ذات طابع سياسي (المجلس) إلى هيئة قضائية (المحكمة) بصلاحيات أوسع تشمل الرقابة على القوانين والانتخابات. ومع ذلك، يشير النص إلى وجود تحديات تعيق أداءها، لاسيما الشروط الإجرائية المعقدة لـ الدفع بعدم الدستورية، وضوابط تعيين الأعضاء، ونقص الوعي القانوني. وتخلص الدراسة إلى أن فاعلية المحكمة في حماية الحريات وتكريس دولة القانون تظل مرتبطة بمدى استقلاليتها العضوية والوظيفية عن السلطة التنفيذية. The 2020 Algerian constitutional amendment marked a significant shift by replacing the Constitutional Council with a Constitutional Court, an independent judicial body aimed at strengthening constitutional oversight and protecting rights and freedoms. Its key competencies include prior and posterior judicial review of laws, resolving inter-authority disputes, and supervising elections and referendums. Despite these expanded powers, the Court faces several limitations, such as complex procedural requirements for the "Plea of Unconstitutionality" and concerns regarding the political appointment of its members. Ultimately, while the Court is a positive step toward the rule of law, its success depends on ensuring its actual independence and fostering a constitutional culture.
