Abstract

هذا البحث بعنوان: القواعد والضوابط الفقهية الحاكمة للمنافسة التجارية وكان الإشكال الرئيس يتمثل في: ما هي القواعد والضوابط الفقهية التي تنظّم وتحكم المنافسة التجارية؟ وللإجابة على هذا الاشكال كانت خطة البحث كالآتي: - المبحث الأول: تناولنا فيه: تعريف المنافسة لغة واصطلاحا ثم تعريف التجارة لغة واصطلاحا، وتعريف المنافسة التجارية. - المبحث الثاني: تم التطرق فيه إلى بيان حكم ومشروعية المنافسة التجارية، مع إبراز أهميتها وأهدافها. - المبحث الثالث: ففي هذا المبحث خلصنا إلى القواعد والضوابط الفقهية المنظمة للمنافسة التجارية. ثم أنهينا البحث بخاتمة ذكرنا فيها أهم النتائج التي خلصنا إليها. This research is entitled: The jurisprudential rules and regulations governing commercial competition. The main problem was: What are the jurisprudential rules and controls that regulate and govern commercial competition? - The first topic: We discussed: the definition of competition linguistically and terminologically, then the definition of trade linguistically and terminologically, and the definition of commercial competition. - The second section: The ruling and legitimacy of commercial competition were discussed, highlighting its importance and objectives. - The third section: In this section, we concluded the jurisprudential rules and regulations regulating commercial competition. Then we ended the research with a conclusion in which we mentioned the most important results that we reached.
