Abstract

الصفقات العمومية للبلدية والتي تعتبر من اهم العقود التي تبرمها من أجل ضمان سير المرفق العام في أحسن الظروف وتلبية مختلف االحتياجات العامة والمتطلبات، لذلك و ضع المشرع الج ازئري خالل مراحل إبرامها وتنفيذها أشكال متعدده من الرقابة، والتي تظهر بمظهرين رقابة إدارية ورقابة قضائية، المظهر االول ويتمثل في الرقابة الداخلية وكذا الرقابة الخارجية سواء كانت قبلية او بعدية، اما المظهر الثاني يتمثل في الرقابة القضائية للقاضي اإلداري وكذلك للقاضي الجزائي، وفق آليات محددة والتي تهدف الى مطابقة الصفقات العمومية للبلدية للتشريع والتنظيم المعمول بهما والحفاظ على المال العام ومحاربة الفساد. The first form is represented by internal control as well as external control, whether prior or subsequent, The second aspect is the judicial oversight exercised by administrative judges and criminal judges, in accordance with specific mechanisms aimed at ensuring that municipal public procurement is in compliance with applicable legislation and regulations, preserving public funds, and combating corruption.
