المبادئ التي تحكم سير المرفق العام ذات القيمة دون الدستورية

Abstract

تتناول هذه الد ا رسة في مجملها مفاهیم عامة حول أهم المبادئ التي تحكم المرفق العام ذات القیمة دون الدستوریة(الشفافیة،الجودة و الجودة،التكیف،الأخلقة،الولوجیة،التشاركیة،التشغیل الصحیح،التنسیق،التعطیل)، ومدى نسبیتها و أهمیتها لكل نظام قانوني، وصولا للعوامل المؤثرة فیها سواء بشكل مباشر أو بشكل غیر مباشر.وجاء في فحواها د ا رسة للنظام القانوني لهذه المبادئ، كما درج البحث على ملامسة عدة جوانب من شأنها إب ا رز الأهمیة الحقیقیة لتلك المبادئ، ومدى الحاجة لدسترتها من عدمه، حیث خلصت الد ا رسة إلى ضرورة دسترة بعضها الذي أضحى یشكل حجر ال ا زویة حدیثا في النظام القانوني للم ا رفق العامة، وهذا للوصول بالمرفق العام للأداء الأمثل، و الوصول لحمایة مصالح الم ا رفق العامة و المنتفعین منها للحدود القصوى. واختتم البحث بضرورة توفیر شروط مناسبة و عوامل ملحة لیتأتى الإد ا رج الدستوري و التكریس الفعلي بنتائج ملموسة علمیا و عملیا.This study deals in its entirety with general concepts about the most important principles governing the public utility of sub-constitutional value (transparency, quality, adaptation, ethics, accessibility, participatory, correct operating , coordination, and disruption of the public utility ), the extent of their relevance and importance to the legal systems, through The factors affecting them, whether directly or indirectly. In this study also, a study of the legal system of these principles, and the search includes several aspects that highlight the true importance of the most important of these principles, and the need for their constitutionalizing or not , as the study concluded that the necessity of constitutionalizing some of them which became newly in such importance in the legal system of public utilities, and this is to reach the public utility for ideal performance, and to protect the interests of public utilities and those who Beneficiaries to the maximum limits. The research concluded with the necessity of providing an appropriate climate and urgent factors in order for the constitutional insertion , to produce true results legally and practically.
