علاقة الأمن القضائي بالأمن القانوني في ‏تجسيد السياسة الجنائية

Abstract

تُعد السياسة الجنائية إحدى الركائز الأساسية التي تعتمدها الدولة في مكافحة الجريمة ‏وتحقيق العدالة، ومن بين أهدافها ترسيخ الأمن القضائي والأمن القانوني، باعتبارهما عنصرين ‏متكاملين.‏ الأمن القضائي يعني ضمان الحقوق والحريات من خلال قضاء نزيه، مستقل ومتخصص، ‏بينما الأمن القانوني يتمثل في وضوح واستقرار النصوص القانونية وتطبيقها بعدالة على الجميع ‏دون تمييز.‏ وترتبط العلاقة بين الأمن القضائي والأمن القانوني بمدى قدرة النظام القضائي على تطبيق ‏القوانين بصورة عادلة وفعالة، دون غموض أو تعسف. فحين تتجسد السياسة الجنائية وفق ‏مبادئ الشرعية والعدالة، فإنها تعزز ثقة المواطن في المنظومة القانونية، مما يحقق الأمنين معًا.‏ بالتالي، فإن تعزيز هذه العلاقة يتطلب إصلاحات تشريعية وقضائية، وضمان الاستقلالية ‏والاحترافية في أداء القضاة، إلى جانب ترسيخ مبدأ المساواة أمام القانون، كجزء لا يتجزأ من ‏تجسيد السياسة الجنائية الحديثة Criminal policy is a fundamental pillar upon which the state relies to combat crime and achieve justice. Among its objectives are the consolidation of judicial and legal security, considered as two complementary elements. Judicial security means guaranteeing rights and freedoms through an impartial, independent, and specialized judiciary, while legal security is embodied in the clarity and stability of legal texts and their fair application to all without discrimination. The relationship between judicial and legal security is linked to the extent to which the judicial system is able to apply laws fairly and effectively, without ambiguity or arbitrariness. When criminal policy is embodied in the principles of legality and justice, it enhances citizens' trust in the legal system, thus achieving both security. Therefore, strengthening this relationship requires legislative and judicial reforms, ensuring the independence and professionalism of judges, and consolidating the principle of equality before the law as an integral part of implementing modern criminal policy.
