أحكام المرأة الذمّية في الفقه المالكي

Abstract

"موضوع المذكرة الموسوم بـ ""أحكام المرأة الذّمّيّة عند المالكيّة""، تمحور البحث فيه حول المسائل الفقهية المتعلقة بالمرأة الذمية في أبواب الفقه المالكي. وقد جاءت الدراسة في مبحث تمهيدي ومبحثين رئيسين؛ فكان المبحث التمهيدي حول أهل الذمة عند المالكية متضمنا تحديد مفهوم عقد الذمة عندهم والأحكام العامة المتعلقة به، أما المبحثان الآخران فاشتملا على مجموعة من المسائل الفقهية المتعلقة بالمرأة الذمية مصنّفة حسب موضوعاتها إلى عبادات وحدود وأحوال شخصية. وخلُص البحث إلى نتائج، أهمّها: أن أحكام الشريعة عامة والفقه المالكي بوجه خاص أنصفت المرأة الذمية، وضمنت لها حقوقا تضمن كرامتها في المجتمع المسلم كالمرأة المسلمة في بعض الأحكام، وأخرى خاصة بها مراعاة لدينها، وأوصىت الدراسة بتوسيع البحث في هذا الموضوع ليشمل بقية المذاهب الفقهية. " The subject of the memorandum, which is marked "judiciary provisions of Malikiyah women", focuses its research on matters of jurisprudence relating to autocratic women in the sections of Maliki jurisprudence the study came in preliminary research and lead researchers; the preliminary research on Malikiyah was designed to define the concept of their contract of invalidity and the general provisions relating thereto. The other two researchers included a series of jurisprudence issues relating to autocratic women classified around their subjects into worship, boundaries and personal conditions. The research concluded that the provisions of sharia in general and Maliki jurisprudence in particular have given justice to women, guaranteeing them rights that guarantee their dignity in Muslim society, such as Muslim women in certain provisions, and others that respect their religion. The study recommended that research on this subject by extended to other doctrin doctrines. م
