تَحْقِيقِ كِتَابِ الْأَقْضِيَةِ مِنْ شَرْحِ تَلْقِينِ الْقَاضِي عَبْدِ الوَهَّابِ (ت422ه) لِلْإِمَامِ أَبِي عَبْدِ اللهِ مُحَمَّدِ بْنِ عَلِيّ الْمَازِرِيِّ (ت536ه) مِنَ اللَّوْحَةِ 303 عِنْدَ قَوْلِهِ: "وَالْجَوَابُ عَنِ السُّؤَالِ الثَّامِنِ عَشَرَ أَنْ يُقَالَ" إِلَى اللَّوْحَةِ 317 عِنْدَ قَوْلِهِ: "فَيَكُونُ هَذَا كَالْمُطَابِقِ لِمَا ذَهَبَ إِلَيْهِ ابْنُ الطَّيِّبِ"

Abstract

"هذه الدراسة الموسومة بـ: ""تَحْقِيقِ كِتَابِ الْأَقْضِيَةِ مِنْ شَرْحِ تَلْقِينِ الْقَاضِي عَبْدِ الوَهَّابِ (ت422ه) لِلْإِمَامِ أَبِي عَبْدِ اللهِ مُحَمَّدِ بْنِ عَلِيّ الْمَازِرِيِّ (ت536ه) مِنَ اللَّوْحَةِ 303 عِنْدَ قَوْلِهِ: ""وَالْجَوَابُ عَنِ السُّؤَالِ الثَّامِنِ عَشَرَ أَنْ يُقَالَ"" إِلَى اللَّوْحَةِ 317 عِنْدَ قَوْلِهِ: ""فَيَكُونُ هَذَا كَالْمُطَابِقِ لِمَا ذَهَبَ إِلَيْهِ ابْنُ الطَّيِّبِ"""" قائمةٌ على تَحْقِيقِ ودراسة هذا الجزءِ منَ الكتابِ؛ مُبْرزَةٌ لِشخصيَّتَيْ صَاحِب المتْنِ وصاحِبِ الشّرْحِ, ومعرِّفةٌ بالكتاب, ومُجيبةٌ على هذه الإشْكَاليَّة: ما ملامِحُ اجتهادِ المازريِّ, ومعالمُ نبوغهِ الفقهيِّ, ومنهجيَّتُة في هذا الجُزْءِ مُقارَنَةً معَ سائِرِ الأَبْوابِ الأُخرَى؟ ثم خَتَمْتُهُ بِما توصَّلتُ إِليْهِ من نتَائِجَ وتوصيَّاتٍ لعلَّ من أبرَزِها: أنَّ هذَا الكِتابَ حَفِظَ لنَا أقوَالًا كثيرةً وآراءَ متعدّدةً لعُلمَاءَ مَحَى الزَّمَانُ آثارَهم, فكانَ مَصْدَرًا في ذلك؛ وعَلَيْه لا بُدَّ من الِاهتِمامِ بِهَذا الـمُؤَلَّف والسَّعْي وراءَ إخراجِه في أَبهَى صُوَرِهِ.
