الطعن في قرارات الوكالة الجزائرية لترقية الاستثمار كآلية لضمان حقوق المستثمر

Abstract

يعد الاستثمار من أهم الوسائل التي تحقق التطور الاقتصادي في الدول، ولذا اهتم به المشرع الجزائري من خلال سن قوانين جديدة، أبرزها القانون رقم 22-18 المتعلق بالاستثمار. تتناول هذه الدراسة أحد أهم أجهزة الاستثمار وهي الوكالة الجزائرية لترقية الاستثمار، حيث تم التركيز بشكل خاص على تكييف مهامها وعرض هيكلها التنظيمي، بالإضافة إلى تسليط الضوء على مختلف الآليات القانونية المنظمة لحق الطعن في قراراتها. وقد توصلت الدراسة إلى جملة من النتائج، أهمها تعدد طرق الطعن في قرارات الوكالة، وسعي المشرع الحثيث لتسهيل هذه الإجراءات أمام المستثمر لضمان حماية حقوقه وتحفيز المناخ الاستثماري. Investment is considered one of the most vital tools for achieving economic development in nations. Consequently, the Algerian legislator has devoted significant attention to it by enacting new legislation, most notably Law No. 22-18 relating to investment. This study examines one of the key investment bodies: the Algerian Investment Promotion Agency (AAPI). It focuses specifically on defining its tasks, presenting its organizational structure, and exploring the various legal mechanisms governing the right to appeal its decisions. The study concluded that there are multiple methods for appealing the agency's decisions, reflecting the legislator's efforts to simplify appeal procedures for investors to ensure the protection of their rights and to stimulate the investment climate.
