حق الإضراب كضمانة ضاغطة لتسوية النزاعات الجماعية للعمل وفق القانون رقم 23-08

Abstract

تسعى هذه الدراسة إلى تسليط الضوء على المنظومة القانونية الجزائرية الخاصة بممارسة حق الإضراب باعتباره ضمانة ضاغطة لتسوية النزاعات الجماعية للعمل، وذلك على ضوء القانون رقم 23-08. تهدف الدراسة إلى تحليل النصوص القانونية والمراسيم التنفيذية المنظمة لها، وتبيان الآليات القانونية لممارسة هذا الحق، ومدى نجاعة الآليات الوقائية كالتفاوض الجماعي واللجان المشتركة، إضافة إلى الآليات العلاجية المتمثلة في المصالحة، الوساطة، والتحكيم. كما تتناول الدراسة دور اللجان الولائية والوطنية التي فعلها المشرع كمسار بديل في حال فشل الوسائل السابقة. وفي سبيل إضفاء المشروعية على ممارسة حق الإضراب، تحاول الدراسة تبيان جملة من الضمانات القانونية التي أوجدها المشرع الجزائري، مع توضيح القواعد الضابطة والناظمة لممارسة هذا الحق بما يضمن التوازن بين حقوق العمال واستمرارية العمل. This study aims to shed light on the Algerian legal framework governing the exercise of the right to strike as a coercive guarantee for settling collective labor disputes, in light of Law No. 23-08. The study analyzes the legal texts and executive decrees organizing this right, illustrating the legal mechanisms for its exercise and the effectiveness of preventive measures such as collective bargaining and joint committees. Additionally, it examines remedial mechanisms including conciliation, mediation, and arbitration. The study also highlights the role of provincial and national committees activated by the legislator as alternative paths when previous mechanisms fail. To enhance the legitimacy of the right to strike, the research explores the legal guarantees established by the Algerian legislator, while clarifying the regulatory rules that govern this right to ensure a balance between workers' rights and the continuity of operation
