Abstract

يعتبر الخبير العقاري في القانون الجزائري (قانون الإجراءات المدنية والإدارية) المساعد الأول للقاضي في المسائل الفنية التي تخرج عن نطاق تخصص المحكمة، حيث يتولى مهاماً حاسمة مثل معاينة العقارات، تحديد المساحات، والتحقق من سندات الملكية. وبالرغم من أن تقرير الخبرة لا يقيد القاضي (رأي استشاري)، إلا أنه يشكل حجر الزاوية في بناء الحكم القضائي، خاصة في قضايا القسمة العقارية، التعدي على الملكية، أو تحديد الحدود، مما يجعل من الخبرة إجراءً تحقيقياً لا غنى عنه لاستجلاء الحقيقة الفنية وتكريس الأمن العقاري The Real Estate Expert plays a vital role in the Algerian legal system as a technical assistant to the judge in matters beyond the court's legal expertise. Under the Code of Civil and Administrative Procedure, experts are tasked with surveying properties, defining boundaries, and verifying ownership documents. Although the expert’s report is advisory and does not legally bind the judge, it serves as the fundamental basis for judicial rulings in disputes such as property partitions and boundary encroachments. This makes forensic expertise an essential investigative measure to ensure technical clarity and safeguard real estate security
