المسؤولية الجنائية الناجمة عن حوادث المرور في التشريع الجزائري

Abstract

شهدت حركة المرور في المجتمعات المعاصرة تطورًا سريعًا، مصحوبًا بزيادة ملحوظة في عدد المركبات، مما أدى إلى تزايد جرائم المرور التي تهدد السلامة العامة. ركزت هذه الدراسة على الجوانب الموضوعية والإجرائية لهذه الجرائم، وتعريفها وتحديد أركانها الثلاثة: القانونية، والمادية، والمعنوية. ثم صنّفتها إلى مخالفات وجنح، مبينةً خصائص كلٍّ منها.

كما تناولت الدراسة دور الجهات المختصة في التحقيق في هذه الجرائم، وطرق إثباتها، والعقوبات المقررة لها، بالإضافة إلى آليات التعويض، لا سيما فيما يتعلق بدور شركات التأمين.

وخلصت الدراسة إلى أن جرائم المرور هي كل فعل يُخالف قوانين المرور، أو يُهدد السلامة العامة، أو يُلحق ضررًا بالأشخاص أو الممتلكات. ويتم التحقيق في هذه الجرائم وفق إجراءات قانونية صارمة، وتخضع لعقوبات تتراوح بين الغرامات والسجن، بالإضافة إلى إجراءات مثل سحب رخص القيادة. وبناءً على ما سبق، أوصت الدراسة بضرورة تكثيف التوعية المرورية، وتحديث التشريعات لمواكبة التطورات التكنولوجية، وتوفير تدريب متخصص للجهات المكلفة بالمراقبة والتفتيش. Traffic in contemporary societies has witnessed rapid development, accompanied by a significant increase in the number of vehicles, leading to an increase in traffic crimes that threaten public safety. This study focused on the substantive and procedural aspects of these crimes, defining them and identifying their three components: legal, material, and moral. It then classified them into violations and misdemeanors, outlining the characteristics of each. The study also addressed the role of agents in investigating these crimes, the methods of proving them, and the penalties imposed, in addition to compensation mechanisms, particularly with regard to the role of insurance .companies The study concluded that traffic crimes represent any act that violates traffic laws, threatens public safety, or causes harm to persons or property. These crimes are investigated according to strict legal procedures and are subject to penalties ranging from fines to imprisonment, in addition to measures such as .the withdrawal of driver's licenses Based on the above, the study recommended the need to intensify traffic awareness, update legislation to keep pace with technological developments, and provide specialized training for agents tasked with monitoring and inspection.
