التحول الرقمي في الإدارة العامة وتحدياته القانونية

Abstract

تهدف هذه الدراسة إلى تحليل التحول الرقمي في الإدارة العامة باعتباره ضرورة استراتيجية تفرضها التطورات التكنولوجية المتسارعة، مع التركيز على التحديات القانونية والتنظيمية المرتبطة به. اعتمدت الدراسة منهجية متعددة الأبعاد تدمج بين المناهج الوصفي التحليلي، والتاريخي، والمقارن لتقديم رؤية شاملة للجوانب التقنية والبشرية والقانونية خلال الفترة (2010-2024). خلصت الدراسة إلى أن التحول الرقمي يمثل إعادة هندسة شاملة للعمليات الإدارية وليس مجرد رقمنة تقنية. كما أكدت النتائج أن نجاح هذا التحول يرتكز على إيجاد توازن دقيق بين المتطلبات البشرية والتقنية، وضرورة صياغة إطار تشريعي مرن يضمن حماية البيانات الشخصية والأمن السيبراني، مع تعزيز التعاون الدولي لمواجهة التهديدات العابرة للحدود. This study aims to analyze digital transformation in public administration as a strategic necessity driven by rapid technological advancements, focusing on the associated legal and regulatory challenges. The study employs a multi-dimensional methodology combining descriptive-analytical, historical, and comparative approaches to provide a comprehensive overview of the technical, human, and legal aspects between 2010 and 2024. The findings reveal that digital transformation represents a fundamental re-engineering of administrative processes rather than mere technical digitization. Furthermore, the results emphasize that successful transformation requires a precise balance between human and technical requirements, the development of a flexible legislative framework to ensure data privacy and cybersecurity, and the strengthening of international cooperation to address transboundary cyber threats.
