Abstract

يعد النظام البيئي نقطة تحول جديدة في مضمون النظام العام نظ ا ر لأهمية موضوع البيئة في المجتمع، مما جعل المشرع الج ا زئري يولي لهذا الموضوع أهمية كبيرة ومت ا زيدة تأث ا ر بالوضع الكارثي للبيئة على المستوى الدولي والداخلي، مما دعاه إلى تبني منظومة قانونية تتضمن مجموعة من الآليات والوسائل المقررة لصالح سلطات الضبط الإداري البيئي بهدف القضاء على المشكلات البيئية والحد منها. وتهدف الد ا رسة لاستع ا رض مختلف تطبيقات فكرة النظام العام البيئي في التشريع الج ا زئري ومدى فعاليت ه )دوره( في إرساء مبادئ الحماية البيئية، و قصد معالجة الموضوع بمختلف جوانبه تم الاعتماد على المنهج الوصفي و التحليلي المناسبين لهذه الد ا رسة و تم التوصل في الختام إلى عدة نتائج أهمها، أن فكرة النظام العام البيئي توسع من سلطات الضبط الإداري و تساعده على ابتكار وسائل جديدة و ناجحة، كما انها تحقق الاهتمام المت ا زيد بالقوانين البيئية ومن ثم بمبادئ الحماية البيئية ومنها ضبط الأنشطة الملوثة للبيئة وحمايتها بالأسلوب الوقائي او الردعي مع تطبيق الجباية البيئية لحماية النظام العام البيئي بجميع عناصره .The environmental system is a new turning point in the content of the general system due to the importance of the environmental issue in society. This made the Algerian legislator give much importance to this issue, especially that the we are witnessing a disastrous situation of the environment both at the national and international levels. This situation urged the legislator to adopt a legal system that includes a set of mechanisms and means established for the benefit of the authorities of the environmental administrative control in order to eliminate and reduce environmental problems. This study aims at showing the various applications of the idea of the general environmental system in the Algerian legislation and its effectiveness (role) in establishing the principles of environmental protection. In order to address the issue in its various aspects, the appropriate descriptive and analytical approaches were relied upon in this study. Several results, therefore, were reached. The most important of which is that the idea of the environmental general system expands the powers of administrative control and helps it to devise new and successful means. It also achieves increasing attention to environmental laws and thus to the principles of environmental protection, including controlling activities that pollute the environment and protecting it in a preventive or deterrent manner with the application of the environmental levy to protect the environmental general system in all its elements.
