التأمينات بين النظام الوضعي والنظام التكافلي (دراسة مقارنة)

Abstract

"يسعى هذا البحث للوقوف على التأمين الوضعي و التأمين التكافلي الإسلامي من حيث نشأته ومفهومه باعتباره نظاما وكذلك باعتباره عقدا ، فضلا عن الوقوف على الواقع التشريعي و التطبيقي للتأمين التكافلي في الجزائر ، وأهم الفروق الأساسية بينه وبين التأمين التقليدي. إضافة تبيان أين الحلال في النظام الوضعي وأين الحرام في النظام التكافلي .
