تحولات المرافق العامة في ضوء إدارة المخاطر الصحية

Abstract

الملخص: تتناول هذه الدراسة التحولات العميقة التي طرأت على المرافق العامة في ضوء تصاعد المخاطر الصحية وما فرضته الاوبئة المستجدة من تغييرات جوهرية على البنية القانونية والتنظيمية لهذه المرافق. وتستمد هذه الدراسة اهميتها باعتبار ان الصحة العامة أضحت عنصرا مؤثرا في سير المرفق العام حيث لم يعد دوره منحصرا في تقديم الخدمة بل صار ملزما بضمان استمراريتها ضمن بيئة يسودها عدم اليقين. وتركز الدراسة في هذا السياق على بيان كيف ساهمت المخاطر الصحية في اعادة تشكيل مفهوم المرفق العام والانتقال به من نموذج اداري تقليدي الى نموذج قائم على المرونة والاستباقية والتكيف مع ابراز أثر التحول الرقمي وادوات الادارة الحديثة في توجيه اداء المرافق العامة. ستكون معالجتنا لهذا الموضوع من خلال تتبع مسار التحولات التي فرضتها المخاطر الصحية على المرافق العامة وفحص الاطار القانوني والتنظيمي الذي يؤطر ادائها في مواجهة المخاطر، وسنعمد الى تحليل مبادئ العمل المرفقي التي طالها التغيير على رأسها مبدا الاستمرارية ومبدا التكيف ومعيار جودة الخدمة مع بيان كيف اعادت المخاطر الصحية صياغة علاقة الادارة بالقانون في ظل الحاجة الى تدخل سريع وفعال يوازن بين الضرورة واحترام الشرعية، كما سنتناول دور الهيئات المتخصصة في الاشراف على ادارة المخاطر وطبيعة التنسيق بين المؤسسات ومدى حاجة التنظيم القانوني الى التحديث لمواكبة هذه التحولات، وتهدف ايضا الى وضع اسس نظرية ومنهجية تساعد على فهم طبيعة التغيير الذي طال المرافق العامة وتوجيه سبل تطويرها بما يضمن خدمه الصالح العام. Abstract This study examines the profound transformations that public services have undergone in response to escalating health risks and the fundamental changes introduced to their legal and regulatory frameworks by emerging epidemics The significance of this study lies in the fact that public health has become a key determinant in the operation of public services Their role is no longer confined to the mere provision of services, it now extends to ensuring their continuity in an increasingly uncertain environment Against this background, the study seeks to demonstrate how health risks have contributed to redefining the concept of public services, shifting from a traditional administrative model to one that is more flexible, proactive, and adaptable, It also highlights the impact of digital transformation and modern management tools on the efficiency and performance of public services. This study traces the impact of health risks on public services and examines the legal and regulatory frameworks governing their operation in response to these risks, It analyses the operating principles of public services that have been affected, including continuity, adaptability, and service quality standards, It also demonstrates how health risks have reshaped the relationship between administration and law, given the need for rapid and effective intervention that balances urgency with respect for the rule of law, In addition, the study addresses the role of specialized bodies in supervising risk management, the nature of inter-institutional coordination, and the need to update legal frameworks to keep pace with these developments Ultimately, the study aims to establish the theoretical and methodological foundations for a better understanding of the transformations affecting public services and to guide their development in a manner that ensures the protection of the public interest.
