Abstract

تُقدّم هذه المطبوعة البيداغوجية دراسة قانونية وإجرائية معمّقة حول منظومة "الشهر العقاري وآليات تسوية منازعاتها"، وهي موجهة لطلبة الحقوق والعلوم القانونية. تم تقسيم محتوى المطبوعة إلى ثلاثة أبواب رئيسية؛ يؤصل الباب الأول للإطار المفاهيمي والقانوني للشهر العقاري، مبيناً أهدافه (القانونية، الاقتصادية، والاجتماعية)، والمقارنة بين نظامي الشهر الشخصي والعيني، بالإضافة إلى الأجهزة الإدارية المتدخلة كالمحافظة العقارية وهيئة مسح الأراضي. وينتقل المؤلف بعد ذلك لدراسة منازعات ما قبل تأسيس السجل العقاري (مثل منازعات الحدود، الحقوق العينية، والترقيم المؤقت والنهائي). أما الباب الثاني، فيستعرض بشيء من التفصيل المنازعات اللاحقة لتأسيس السجل العقاري وآليات حلها، بما في ذلك دعاوى بطلان وفسخ التصرفات العقارية، والطعن في قرارات المحافظ العقاري بالرفض، مستعرضاً دور القضاء (العادي والإداري)، والبدائل الودية كالوساطة والخبرة الفنية، مع إسقاط مقارن على المنظومتين المصرية والفرنسية. وأخيراً، يسلط الباب الثالث الضوء على أبرز التحديات التشريعية والإجرائية التي تواجه هذا النظام (كغموض النصوص ونقص الرقمنة)، واضعاً آفاقاً تطلعية لتطوير المنظومة عبر التحول الرقمي وتبني السجل العقاري الإلكتروني لتعزيز الشفافية وحماية البيانات لدعم التنمية الاقتصادية. This pedagogical handout offers a comprehensive legal and procedural analysis of the "Real Estate Registration System and its Dispute Resolution Mechanisms," tailored for law students. The content is structured into three main parts. Part One establishes the conceptual and legal framework of real estate registration, highlighting its legal, economic, and social objectives. It compares personal and in-rem registration systems and reviews key administrative bodies such as the Land Registry and the Cadastral Survey. This section also addresses pre-establishment registration disputes, including boundary disputes, in-rem rights, and temporary versus definitive registration conflicts. Part Two thoroughly examines disputes arising after the establishment of the land registry and their resolution mechanisms. This includes lawsuits for the nullity or rescission of real estate transactions, appeals against the Land Registrar’s decisions, and the roles of both ordinary and administrative courts. It also covers alternative dispute resolution (ADR) mechanisms, such as mediation and expert assessments, supplemented by a comparative analysis of the Egyptian and French systems. Finally, Part Three sheds light on the legislative and procedural challenges facing the system, such as legal ambiguities and inadequate digitalization. It proposes strategic horizons for development through digital transformation and the adoption of an electronic land registry to enhance transparency, secure data, and foster economic developme
