الفتاوى المعاصرة بين ضوابط الشريعة ومقتضيات الواقع

Abstract

يعالج هذا البحث أبرز الإشكالات التي تعترض العمل الإفتائي المعاصر من خلال بيان أهم الضوابط الشرعية وكيفية تفعيلها في الواقع العملي ومتغيراته على مختلف المستويات. وتنطلق الدراسة من تعريف الفتوى وبيان أهميتها، لتتطرق إلى أثر البعد المقاصدي وقواعد الفقه في صناعة الفتوى، ثم بيان أهمية فقه التنزيل في الفتاوى المعاصرة، وكذا التأهيل لوظيفة الإفتاء ومقتضياته، ثم الفتاوى المجمعية وسبل ترقيتها، وفي الأخير تعرض لنماذج من الفتاوى المعاصرة، وبيان عدد من التوصيات لحسن ضبط وتوجيه وتفعيل الفتاوى المعاصرة. This research deals the most problems witch face the contemporary work of Fatwa. by showing the most important rules of Charia and how to activate it in practice and variables at different levels. This study starts from the definition of fatwa and indicates its importance, then it deals with the impact of the purpose dimension and the rules of Fiqh in the Fatwa. This research also shows the importance of the Fiqh Tanzil in contemporary Fatawa, as well as the qualification of the function Fatwa, and its requirements, Fatwas Fiqh Academies and ways of developing them. Finally, the research deals with models of contemporary Fatawa, it also shows a number of recommendations in order to adjust, direct and activate contemporary fatwas
