دور المحكمة الدستورية في الرقابة على احترام الحقوق والحريات الأساسية

Abstract

تُعدُّ الرقابة الدستورية أهم الأسس التي يقوم عليها مبدأ السُّمو الدستوري وبناء دولة الحق والقانون، والحصن المتين لحماية الحقوق والحريات الأساسية، التي تتخذ من الرقابة وسيلة دستورية خصّ بها الُشرع هيئات دستورية خاصة منوط بها القيام بذلك. انّ استحداث المحكمة الدستورية من خلال التعديل الدستوري لسنة2020، وتكليفها بمهمة الرقابة على احترام الحقوق والحريات الأساسية، منعا لأي اعتداء قد تتعرض له من أي سلطة بمناسبة ممارستها لمهامها، حيث تراقب المحكمة الدستورية مدى دستورية القوانین والتنظيمات والتشريعات والمعاهدات للدستور، ومدى احترام السلطات العامة للدستور، إذ تعمل وفق آلية الإخطار وتفعيل الدفع بعدم الدستورية لضمان احترام الحقوق والحريات الأساسية، وتساهم في الحد من السلطة التقديرية للمشرع بواسطة إعمال التحفظات التفسيرية، حيث تتدخل من خلال رقابتها لتطوير القاعدة القانونية وضمان جودة التشريع وصولا لتحقيق الأمن القانوني، كما تتصدى لتقاعس المشرع أو تسلُّبه أو امتناعه عن مراقبة مدى احترام الحقوق والحريات الأساسية عبر الاجتهادات التي تصدر عنها في شكل قرارات وآراء. Abstract: Constitutional oversight is the most important foundation upon which the principle of constitutional supremacy and the building of a state of law and justice are based. It is also a solid fortress for the protection of fundamental rights and freedoms, which rely on oversight as a constitutional means that Sharia has designated for special constitutional bodies entrusted with carrying out this task. The establishment of the Constitutional Court through the 2020 constitutional amendment, and its assignment to the task of monitoring respect for fundamental rights and freedoms, to prevent any attack it may be subjected to by any authority in the exercise of its duties, The Constitutional Court monitors the constitutionality of laws, regulations, legislation and treaties, and the extent to which public authorities respect the Constitution, It operates in accordance with the notification mechanism and activates the plea of ​​unconstitutionality to ensure respect for fundamental rights and freedoms. It contributes to limiting the legislator's discretionary power by implementing interpretative reservations, as it intervenes through its oversight to develop the legal basis and ensure the quality of legislation in order to achieve legal security. It also confronts the legislator's negligence, evasion, or refusal to monitor the extent of respect for fundamental rights and freedoms through its interpretations and applications issued in the form of decisions and opinions.
