الأسرة بالمغرب الأوسط بين الضوابط الشرعية والقيود العرفية (6-10هـ/12-16م)

Abstract

الملخص: ملخص الدراسة : يتناول موضوع الأطروحة البحث في حياة الأسرة بالمغرب الأوسط خلال الفترة الزمنية الممتدة من القرن 6-10ه/12-16م من خلال الوقوف على الحياة الدينية للأسرة ومدى تمسكها بالعادات والتقاليد الاجتماعية الموروثة، وذلك بتسليط الضوء على طبيعة تكوين الأسرة عبر مراحل البناء الأسري والزواج الذي هو سبيل ذلك، الذي راعى فيه المجتمع التمسك ببعض العادات مع الوقوف على أحكامه الشرعية ومحاولة الفقهاء ضبطه وفق الأسس الدينية الصحيحة. كما تطرق الموضوع إلى الاهتمام بعدة قضايا شغلت بال الأسرة وخلقت عدة مشاكل اجتماعية بين الأزواج كدفع المهور والشوار وتوفير المسكن وغيرها استدعت تدخل الفقهاء لتجنب هذه المشاكل التي تفضي إلى طريق الطلاق أو الخلع، وهذه المشاكل أثرت على العلاقات الزوجية والاجتماعية وساهمت في التفكك الأسري والاجتماعي، كما عالج الموضوع مظاهر الحياة اليومية للأسرة والتي شملت الاحتفالات والأعياد والمناسبات الدينية والاجتماعية وعاينت مدى تمسكها بالشريعة الإسلامية في اطار ممارسة طقوسها الاحتفالية. ولامس الموضوع جوانب مهمة من حياة الأسرة بالمغرب الأوسط من حيث تأثرها بالتيارات المذهبية التي دخلت البلاد وتوطنت بها، كما عرج الموضوع على دراسة واقع الأسرة خلال الأحداث والأزمات السياسية والحروب والمجاعات والأمراض والأوبئة، وتأثير ذلك كله على المنظومة الأسرية.

Study Summary: This dissertation explores family life in the Central Maghreb during the period extending from the 6th to the 10th century AH (12th–16th century CE). It examines the religious life of the family and the extent to which it adheres to inherited social customs and traditions. The study sheds light on the structure of the family through the various stages of its formation, particularly through marriage — the primary means of establishing a family — while highlighting society’s commitment to certain customs. It also explores the legal rulings related to marriage and how scholars sought to regulate it according to sound religious principles. The study further addresses various issues that concerned families and led to numerous social problems between spouses, such as dowries, furnishing the marital home, and providing adequate housing. These issues often necessitated the intervention of jurists to prevent outcomes such as divorce or annulment, which negatively affected marital and social relations and contributed to familial and societal disintegration. Additionally, the research investigates aspects of daily family life, including celebrations, religious and social holidays, and occasions, analyzing how families adhere to Islamic law while practicing these festive rituals. The study also touches on significant aspects of family life in the Central Maghreb, particularly its exposure to and influence by various religious currents that entered and settled in the region. Furthermore, it examines the state of the family during times of political unrest, wars, famines, diseases, and epidemics, and the overall impact of these crises on the family system.
