حظر خطاب الكراهية والتمييز في الحملة الانتخابية في التشريع الجزائري دراسة على ضوء القانون رقم 20/05 والأمر رقم 21/01

Abstract

نناقش في هذه الورقة البحثية موضوع تأطير المشرع الجزائري لحظر خطاب الكراهية والتمييز في الحملة الانتخابية، مستعملين المنهج التحليلي، فتوصلنا لعدة نتائج، أهمها أن المشرع الجزائري اعتمد القانون الدولي، وتوصيات المنظمات الدولية، فيما يخص حظر خطاب الكراهية والتمييز في الحملة الانتخابية، من خلال الأمر رقم 21/01، والقانون رقم 20/05، وكان أسلوبه في معالجة هذه المسألة متشددا، إلا أنه أغفل بعض المسائل المهمة. In this research paper, we discuss the issue of framing the Algerian legislator to ban hate speech and discrimination in the electoral campaign, using the analytical approach, we reached several results, the most important of which is that the Algerian legislator adopted international law, and the recommendations of international organizations, regarding the prohibition of hate speech and discrimination in the electoral campaign, Through Order No. 21/01 and Law No. 20/05, and his approach to this issue was strict, but he neglected some important issues.
