ضوابط الالتزام بالمعاهدات الدولية - دراسة مقارنة بين الفقه الإسلامي والقانون الوضعي -

Abstract

أدى النظام الدولي المعاصر بأنظمته السياسية الحديثة، إلى انقسام المجمع الدولي إلى عدد كبير من الدول، وارتباط بعضها ببعض بعدد كبير من المعاهدات والمواثيق الدولية، إلا أن هذه المعاهدات والمواثيق الدولية قد تتضمن قواعد قانونية تخالف تلك القواعد والأحكام التي تقيمها الأنظمة الداخلية للدول، مما يطرح إشكالا أمام هذه الدول مسلمة كانت أو كافرة عن الالتزام بأحكام تلك المعاهدات المواثيق الدولية التي تخالف أنظمتها الداخلية، وهذا يستلزم معرفة الضوابط التي تبين ما يجب التزامه وما لا يجب، ولهذا جاء البحث لبيان القواعد والأحكام الشرعية والقانونية التي تضبط إبرام المعاهدات والاتفاقيات الدولية والالتزام بها، مع التنبيه إلى أن هذه الاتفاقيات هي فعلا من بين الحلول التي تساعد المسلمين على مواجهة الصور المستجدة في علاقاتهم مع غيرهم من الأمم، لكن مع الحرص على التحفظ على كل ما هو مخالف لتعاليم الإسلام. modern political systems has led to the division of the international community into a large number of states, some of which are interconnected through numerous international treaties and agreements. However, these international treaties may contain legal rules that contradict the rules and provisions established by the internal systems of states, posing a dilemma for these states, whether Muslim or non-Muslim, in terms of complying with the provisions of these treaties that contradict their internal systems. This necessitates understanding the criteria that determine what should be complied with and what should not. Therefore, this research aims to clarify the legal and Sharia rules that regulate the conclusion of international treaties and agreements and compliance with them, with an emphasis that these agreements are indeed among the solutions that help Muslims face the evolving dynamics in their relations with other nations, while ensuring adherence to everything that is not contrary to Islamic teachings
