تأديب الأطفال – المشروعية والوسائل- دراسة مقارنة بين الشريعة الإسلامية والقانون الجزائري

Abstract

ملخص: يقصد بالتأديب تلك العملية التربوية التي تهدف إلى تقويم سلوك الأطفال الغير مقبول بوسائل مختلفة، وقد اعتبرت الشريعة الإسلامية والمشرع الجزائري حق تأديب الأطفال ملازم لحق الولاية المسند للأولياء ومن يشاركهم مهمة التربية والتعليم. والطرق المتبعة في عملية التأديب عديدة يمكن تصنيفها حسب شدّتها وارتباط الوسيلة المستعملة بجسد الطفل إلى مادون الإيذاء الجسدي؛ كالنصح والتوجيه، والزجر، وتأديب بالإيذاء الجسدي؛ كالضرب، وعلى المربي أن يتدرج في تأديب الأطفال ولا ينتقل إلى الإيذاء الجسدي إلا بعد استنفاد ما دون ذلك وفق ضوابط ينبغي احترامها. Abstract: The purpose of this discipline is to assess the behavior of children which is unacceptable in various ways, and Islamic law and the Algerian legislator have considered the right to discipline children as inherent in the rights of the guardianship and those who participate in the task of education. The methods used to discipline children are numerous and can be classified according to their severity and their attachment to the child's body to discipline, without physical abuse, such as counselling, guidance and coercion, and physical abuse, such as beating, and the parent must be included in the discipline of children and not physically abused until they have been exhausted, according to regulations that should be respected.
