إلتزام المنتج بتتبع مسار سلامة منتوجاته في مواجهة مخاطر التطور العلمي دراسة تحليلية في التشريع الجزائري والمقارن

Abstract

بفضل التقدم العلمي الذي عقب الثورة الصناعیة ظهرت منتوجات ذات تكنولوجيا عالية و أكثر رفاهیة، إلا أن هذه المنتوجات في ذات الوقت معقدة التركيبة ، وتحمل في طیاتها أخطارا كامنة تهدد حیاة البشر يصعب إكتشافها، وقد لا یكون من الممكن إكتشاف تعيبها في حدود المعرفة الفنیة السائدة وقت الإنتاج أو وقت طرح المنتوج للتداول . ومن ثم بات لازما على المنتج تتبع سلامة منتوجاته بمراقبتها طيلة مسار حياتها لاسيما مرحلة التسويق وعند الإستهلاك، للتصدي لكل الأضرار الناتجة عن تعيبها فور العلم بها، وإتخاذ كل الإجراءات والتدابير اللازمة ، وفق ما تتطلبه معطيات حالة المعرفة العلمية والفنية المتطورة في إطار الوفاء بالإلتزام ، بإخبار المستهلك بمخاطر المنتوج أوسحبه أو إسترجاعه أو تعليق الخدمة.....إلخ . Due to the scientific progress that occurred after the Industrial Revolution, many products of high technology appeared. However, those products are of complex structures and they carry hidden dangers that threaten the human life. It may not be possible to discover the drawbacks of the those products when they were produced or marketed. Thus, it is of high importance for the producers to follow the safety of their products and controlling them through the marketing and the consuming stages. Moreover, they should face all the drawbacks as soon as they discover them and take all the necessary procedures by telling the consumer about the risks of the product, pull it out of the market, retrieved it, suspending service…etc.
