الآليات الوقائية لمكافحة المضاربة غير المشروعة في التشريع الجزائري

Abstract

الملخص: تعد المضاربة غير المشروعة من أخطر الممارسات التي تهدد استقرار السوق والمساس بالقدرة الشرائية للمستهلك، ولقد أدرك المشرع خطورتها خاصة في ظل الأزمات الاقتصادية والصحية والمناسبات وهو ما دفعه إلى سن القانون 21-15 المتعلق بالمضاربة غير المشروعة والذي سعى من خلاله لإرساء مقاربة قانونية شاملة لا تقتصر على التجريم والعقاب بل تمتد للوقاية والرصد المبكر للاختلالات السوق ومنه يبرز الدور الوقائي لمؤسسات الدولة سواء على المستوى المركزي أو على المستوى المحلي باعتبارها الفاعل الأساسي في ضبط السوق ومراقبة الممارسة التجارية ومنه صون القدرة الشرائية للمستهلك.. Abstract: Unlawful speculation is regarded as one of the most dangerous practices that threaten market stability and undermine consumers’ purchasing power. The Algerian legislator has recognized its seriousness, particularly in times of economic and health crises and during peak seasons and special occasions. This awareness prompted the enactment of Law No. 21-15 on combating unlawful speculation, which aims to establish a comprehensive legal approach that goes beyond criminalization and punishment to include prevention and the early detection of market disruptions. Accordingly, the preventive role of public institutions becomes evident at both the central and local levels, as they constitute the principal actors in market regulation and the oversight of commercial practices, thereby safeguarding consumers’ purchasing power.
