مسلك الدعوى القضائية لإعادة النظر في الترقيم العقاري والاستثناءات الواردة عليه في التشريع الجزائــــري

Abstract

تعد الدعوى القضائية المسلك الوحيد لإعادة النظر في الترقيم العقاري عندما أخذ المشرع بالحجية النسبية للحقوق الناتجة عن القيد الأول في السجل العيني، ويتوزع اختصاص الفصل في الدعوى بين القضاء العادي بالنسبة لمنازعة الترقيم المؤقت بين الخواص، والقضاء الإداري بمنازعة الترقيم النهائي والترقيم المؤقت التي يكون أحد أطرافها من شخصا عاما. غير أن الإدارة استحدثت استثناءات لمعالجة الإشكالات التي أثارها أصحاب العقارات التي رُقِّمَتْ للغير وذلك دون اللجوء للقضاء مخالفة للتشريع وما استقر عليه القضاء، وإذا اعتبرنا ذلك تطبيقا لإرادة صاحب الترقيم وتغليب السند الأقوى فإن ذلك يبقى مرسخا بتعليمات شاذة عن الأصل العام مما يجب تقنينها أو إلغائها. The judicial case is the only way to reconsider the real estate numbering when the legislator took the relative authority of the rights resulting from the first entry in the real record, and the jurisdiction to decide on the case is divided between the ordinary judiciary in relation to the dispute of temporary numbering among private persons, and the administrative judiciary in the dispute of the final numbering and the temporary numbering of which one of the parties is from a public person. However, the administration has created exceptions to address the problems raised by the owners of real estate that have been numbered to others, without resorting to the judiciary, in violation of the legislation and what the judiciary has settled on.
