Abstract

تناكلنا في بحثنا ىذا قاعدة ابغكم يدكر مع علتو كجودان كعدمان،؛فهي قاعدة أصولية، كما أنها قاعدة فقهية؛ لأنها تتعلق بالأدلة الشرعية كتستخد لاستنباط الأحكا؛ لأف ابغكم في القاعدة ىو ابغكم الفقهي التكليفي الوضعي من حلاؿ كحرا كصحة كشرط كبكوىا، لأف بؽا تأثتَ في بصيع الأبواب الفقهية من العبادات إلى ابؼعاملات فيدكر ابغكم مع علتو؛ فحيثما كجدت العلة كجد ابغكم، كحيثما انتفت العلة انتفى ابغكم، كللعلة صور عديدة في الدكراف عند توفر شركطها كضوابطها.
