نظام وقف تنفيذ المقررات القضائية الإدارية بين الواقع و التطبيق

Abstract

يعالج هذا البحث موضوع وقف تنفيذ القرارات القضائية الإدارية وفق قانون الإجراءات المدنية والإدارية حيث أن المشرع أفرد نظاما إستثنائيا خاصا يتيح وقف تنفيذ المقرر القضائي متى توافرت مبررات اللجوء إلى هذا الطريق ومنه تقييد الطابع التنفيذي لحين البت في أصل النزاع. لذا نعالج معالم هذا النظام وخباياه من خلال دراسة مواده القانونية والوقوف على مدى فعاليتها وانسجامها في النص التشريعي. Abstract: This research aims to shed light on the stay of enforcement of Judicial administrative decisions in the Algerian Administrative and civil procedures. The Legislator has established an exceptional system based on cancelling those Judicial Administrative decisions with suspending their executive effect. Our view about this needs a deal with the relief and the effectiveness of the legal texts.
