خصخصة الأعمال الإنسانية للأمم المتحدة في القانون الدولي المعاصر

Abstract

لقد سعت منظمة الأمم المتحدة منذ وجودها إلى تحقيق الأمن و السلم الدوليين على مستوى العالم و هذا من خلال أجهزتها المختلفة و بإتباع آليات عديدة و تعتبر الأعمال الإنسانية التي تقوم بها المنظمة أهم و اعقد موضوعات عملها و انتهجت من اجل تحقيق مقاصدها الخصخصة الأمنية و هو موضوع الأطروحة . حيث تمت هذه الدراسة انطلاقا من توضيح المحددات القانونية المنتهجة من اجل خصخصة الأعمال الإنسانية و تبني الشركات الأمنية و العسكرية الخاصة كأداة لهذا مع توضيح مفهوم هاته الشركات و مشروعية عملها , توضيح النظام القانوني لعملها و تبيان نطاق عملها ضمن أعمال منظمة الأمم المتحدة و الإطار القانوني لذلك و توضيح دور المنظمة الأممية و المنظمات و كذا الدول من اجل تنظيم ذلك مع توضيح دور خصخصة الأعمال الإنسانية في القانون الدولي من خلال التدخل الدولي الإنساني و عمليات حفظ السلام مع تحديد مسؤولية منظمة الأمم المتحدة من ذلك Abstract: Since its inception, the United Nations has sought to achieve international security and peace worldwide through its various agencies and by following numerous mechanisms, the humanitarian work carried out by the organization is considered the most important and complex aspect of its work, and it has pursued security privatization in order to achieve its objectives, which is the subject of this thesis. This study was conducted based on clarifying the legal determinants adopted for the privatization of humanitarian work and the adoption of private security and military companies as a tool for this, while clarifying the concept of these companies and the legality of their work. clarifying the legal system governing their work and the scope of their work within the United Nations and the legal framework for this, and clarifying the role of the UN, other organizations, and states in regulating this, with an explanation of the role of the privatization of humanitarian work in international law through international humanitarian intervention and peacekeeping operations, with a definition of the UN's responsibility in this regard
