Abstract

الملخص: تتناول هذه الدراسة موضوع ضمانات حماية حقوق الأبناء في التشريع الجزائري، من خلال تحليل الإطار الدستوري والتشريعي والمؤسسي المنظم لحمايتها، وبيان مدى كفاية الضمانات الموضوعية والإجرائية التي أقرها المشرع الجزائري لضمان التمتع الفعلي بهذه الحقوق، في ضوء أحكام الدستور الجزائري، واتفاقية حقوق الطفل لعام 1989، والتشريعات الوطنية ذات الصلة، ولا سيما القانون رقم 15-12 المتعلق بحماية الطفل. وتنطلق الدراسة من إشكالية رئيسية تتمثل في مدى توفيق المشرع الجزائري في إقرار ضمانات قانونية تكفل حماية حقوق الأبناء، ومدى كفاية هذه الضمانات وفعاليتها في التطبيق العملي، وانسجامها مع المرجعيات الدستورية والالتزامات الدولية، وقدرتها على مواكبة التحولات الاجتماعية والمستجدات التي تمس الطفولة. واعتمدت الدراسة المنهج الوصفي والتحليلي، من خلال تحليل النصوص الدستورية والتشريعية والاتفاقيات الدولية، واستقراء الاجتهادات الفقهية والقضائية ذات الصلة، مع تتبع تطور الحماية القانونية منذ دستور 1989 إلى دستور 2020. وتوصلت الدراسة إلى أن المشرع الجزائري أحرز تطورا ملحوظا في مجال حماية حقوق الأبناء، من خلال دسترة عدد من المبادئ الأساسية، ومواءمة التشريع الوطني مع أحكام اتفاقية حقوق الطفل، واستحداث آليات مؤسسية متخصصة، في مقدمتها الهيئة الوطنية لحماية وترقية الطفولة، ومصالح الوسط المفتوح، ونظام قضاء الأحداث. كما شكل القانون رقم 15-12 نقلة نوعية بإرسائه منظومة متكاملة لحماية الأطفال المحتاجين إلى الرعاية الاجتماعية، والأطفال في خطر، والأطفال الجانحين تقوم على تغليب المصلحة الفضلى للطفل، والوقاية، والإصلاح، وإعادة الإدماج. وفي المقابل، كشفت الدراسة عن عدد من أوجه القصور، من أهمها تشتت الأحكام القانونية بين عدة نصوص، وعدم استكمال بعض النصوص التنظيمية، وغياب معالجة تشريعية لبعض صور الخطر المستحدثة، ولا سيما في البيئة الرقمية، إضافة إلى استمرار الفجوة بين الحماية القانونية المقررة والتطبيق العملي، نتيجة تفاوت الإمكانات البشرية والمؤسسية وضعف التنسيق بين مختلف الجهات المتدخلة في حماية الطفل. وانتهت الدراسة إلى اقتراح جملة من التدابير الرامية إلى تعزيز فعالية المنظومة القانونية من خلال استكمال البناء التشريعي والتنظيمي، وتوحيد المرجعية القانونية الخاصة بحقوق الأبناء، وتطوير الحماية من المخاطر المستحدثة، وتعزيز التنسيق المؤسسي، بما يضمن حماية قانونية أكثر شمولاً وفعالية لحقوق الأبناء في الجزائر. Abstract: This doctoral dissertation examines the legal guarantees for the protection of the rights of children in Algerian legislation by analyzing the constitutional, legislative, and institutional framework governing their protection. It aims to assess the adequacy of the substantive and procedural guarantees established by the Algerian legislator to ensure the effective enjoyment of these rights, in light of the Algerian Constitution, the 1989 Convention on the Rights of the Child (CRC), and the relevant national legislation, particularly Law No. 15-12 on Child Protection. The study is based on a central research question concerning the extent to which the Algerian legislator has succeeded in establishing legal guarantees capable of protecting the rights of children, the adequacy and practical effectiveness of these guarantees, their consistency with constitutional principles and international obligations, and their ability to respond to contemporary social developments and emerging challenges affecting childhood. To address this issue, the study adopts a descriptive and analytical approach, relying on the examination of constitutional and legislative provisions, international legal instruments, as well as relevant doctrinal and judicial writings. It also traces the evolution of the legal protection of children's rights from the 1989 Constitution to the 2020 Constitution. The study concludes that the Algerian legislator has made significant progress in strengthening the protection of children's rights through the constitutional recognition of fundamental child rights, the harmonization of domestic legislation with the Convention on the Rights of the Child, and the establishment of specialized institutional mechanisms, notably the National Authority for the Protection and Promotion of Children, the Open Environment Services, and the Juvenile Justice System. Furthermore, Law No. 15-12 constitutes a major legislative milestone by introducing an integrated framework for the protection of children in need of social care, children at risk, and juvenile offenders, based primarily on the principles of the best interests of the child, prevention, rehabilitation, and social reintegration. However, the study also identifies several shortcomings that limit the practical effectiveness of these guarantees. These include the fragmentation of child protection provisions across different legislative texts, the absence of certain implementing regulations, the lack of adequate legal regulation of emerging risks particularly those arising from the digital environment-and the persistent gap between legal protection and its effective implementation due to disparities in institutional and human resources, as well as insufficient coordination among the various institutions responsible for child protection. Finally, the study proposes a number of practical measures aimed at enhancing the effectiveness of the Algerian child protection system through the improvement of the legislative and regulatory framework, the unification of the legal framework governing children's rights, the strengthening of protection against emerging risks, and the reinforcement of institutional coordination, thereby ensuring more comprehensive and effective legal protection of children's rights in Algeria.
