النظام القانوني للعقار المنجمي في التشريع الجزائري

Abstract

تتمحور هذه الدراسة حول النظام القانوني للعقار المنجمي في الجزائر في ظل القانون رقم ،12-25 والذي لمبدأ " انفصال ملكية الباطن عن السطح" الموروث عن التشريعات السابقة؛ حيث تظل وتكريسا جاء تأكيدا ملكية الرقبة للدولة بينما يتمتع المستثمر بحق عيني عقاري مؤقت. ولتحقيق ذلك، تم تحليل الإطار المفاهيمي والمؤسساتي للعقار المنجمي، بإبراز طبيعته القانونية والدور الضبطي للوكالة المنجمية، كما تناولت الدراسة آليات منح واستغال هذا العقار، عبر شرح المسار الإجرائي للسندات والرخص، وتحليل منظومة الحقوق والالتزامات وآليات الرقابة التي تضمن عدم انحراف المستثمر. خلصت الدراسة إلى أن القانون 12-25 يهدف إلى تطوير حوكمة العقار المنجمي وضبط آليات استغلاله، لتحويله من مجرد ثروة باطنية إلى وعاء استثماري فعال يوازن بين الحماية السيادية للدولة ومتطلبات التنمية المستدامة، بما ينسجم مع التوجهات الجديدة للاستثمار في الجزائر This study focuses on the legal regime of "Mining Real Estate" in Algeria under Law No. 12-25, which reaffirms and enshrines the principle of "separation of subsoil ownership from surface ownership"—a principle inherited from previous legislation. Under this framework, the State retains bare ownership of the subsoil, while the investor is granted a temporary real property right. To achieve this, the study analyzes the conceptual and institutional framework of mining real estate, highlighting its legal nature and the regulatory role of mining agencies. It also examines the mechanisms for granting and exploiting this real estate by explaining the procedural path for mining titles and permits, while analyzing the system of rights, obligations, and oversight mechanisms that prevent investor non-compliance. The study concludes that Law No. 12-25 aims to develop the governance of mining real estate and regulate its exploitation, transforming it from mere subsoil wealth into an effective investment vehicle that balances the State's sovereign protection with the requirements of sustainable development, in alignment with Algeria's new investment orientations.
