دور السلطة الوطنية المستقلة للإنتخابات في ضمان نزاهة العملية الإنتخابية

Abstract

اعتمدت الجزائر منذ الاستقلال الانتخاب كوسيلة ديمقراطية لممارسة حق الشعب في اختيار من يمثله في الحكم وتقرير مصيره، ولذلك استحدث جهازا مستقلا حل محل السلطة التنفيذية، وشفعها بمجموعة من القوانين بدء من التعديل الدستوري لسنة 2020 إلى الأمر 21-01 المتعلق بالنظام الانتخابي، وهو موضوع هذه الأطروحة؛ حيث قمت بإجراء هذه الدراسة انطلاقا من النظام الانتخابي المعتمد في الجزائر وأشكاله وصوره، ومنه إلى النظام القانوني والوظيفي لهذه السلطة، من تشكيلتها ومهامها وصلاحياتها وشروط العضوية فيها، إلى الضمانات الدستورية والقانونية كضمانات الحملة الانتخابية ومراقبة تمويلها، وضمانات الأحكام المتعلقة بعملية التصويت والاقتراع والفرز، ومنه إلى ضمانات الأحكام الجزائية والإجرامية، إلى غاية الإعلان على النتائج الانتخابية، دون أن ننسى علاقة السلطة الوطنية المستقلة بالمحكمة الدستورية في إضفاء المصداقية والنزاهة على عمل السلطة المستقلة، وكذا مستجدات الذكاء الاصطناعي الذي لم تظهر دراسات معمقة حول تأثيره على الانتخابات وعمل السلطة الوطنية المستقلة للانتخابات. Abstract Since gaining independence, Algeria has adopted elections as a democratic means for the people to exercise their right to choose their representatives in governance and to determine their own destiny. To that end, an independent body was established to replace the executive authority, supported by a set of laws starting from the 2020 constitutional amendment to Ordinance 21-01 related to the electoral system, which is the subject of this dissertation; This study was conducted based on the electoral system adopted in Algeria, its forms and manifestations, and then moved on to the legal and functional framework of this authority — including its composition, duties, powers, and membership criteria — as well as the constitutional and legal safeguards such as those related to the electoral campaign, its funding oversight, and guarantees concerning voting, polling, and vote counting procedures. The study also addresses legal and criminal safeguards up to the announcement of election results, without overlooking the relationship between the Independent National Authority and the Constitutional Court in ensuring the credibility and integrity of the authority's work. Furthermore, the study touches on developments in artificial intelligence, an area still lacking in-depth research on its impact on elections and the functioning of the Independent National Authority for Elections.
