Abstract

ملخص المضمون:

مشكلة البحث: تكمن في مدى تأثير تطبيق قاعدة سد الذرائع على الفتاوى المعاصرة في قضايا الأسرة والأحوال الشخصية، للحد من الفجوة بين الفقه الميداني والتأصيل الأصولي نتيجة إغفال هذه القاعدة في بعض الفتاوى.

هيكلية الدراسة:

الجانب النظري: يتناول تعريف القاعدة، علاقتها بالأدلة الشرعية ومقاصد الشريعة، حديّتها، وضوابط إعمالها.

الجانب التطبيقي: يدرس مسائل معاصرة في الأحوال الشخصية لتوضيح الأثر العملي لتطبيق القاعدة. أبرز النتائج: سد الذرائع يُقصد به: منع المباح في الظاهر إذا كان يوصل إلى مفسدة أو محرم. للقاعدة أثر بارز ومباشر في توجيه الفتاوى المعاصرة، لا سيما في مجال الأحوال الشخصية. This research presents a study of the legal principle of blocking the means and its impact on contemporary fatwās, confined specifically to the domain of personal status law. Upon reviewing contemporary fatwās, we find that many of them overlook this principle-thereby widening the gap between fiqh and its foundational principles. The central issue raised by this topic is: To what extent does the principle of blocking the means influence contemporary fatwās in the field of personal status law? This study sheds light on the aforementioned principle from two angles: • The theoretical aspect, which clarifies its essence, its relationship with Sharīʿah evidence and the higher objectives of Islamic law, followed by an exposition of its juristic validity and its governing condition . • The applied aspect, which presents contemporary issues within personal status law and demonstrates the effect of blocking the means upon them. Among the most important findings of this research are: • blocking the means entails prohibiting an act that is apparently permissible solely because it leads to something prohibited • It exerts a clear and tangible influence on contemporary fatwās - especially in matters of personal status.
